Certification of Specialized Programs

These rules provide for the certification of specialized programs offered in adult foster care homes to clients with mental illness of developmental disabilities. These rules would be amended to: 1. Strengthen the person-centered planning process. 2. Address adequacy of direct care staffing and retention.

Adult Foster Care Family Homes Licensing Rules
(Human Services, Office of Children and Adult Licensing)

These rules adult foster care family homes. These rules address:(a) The operation and conduct of adult foster care facilities.(b) The character, suitability, training, and qualifications of applicants and other persons directly responsible for the care and welfare of adults served.(c) The general financial ability and competence of applicants to provide necessary care for adults and to maintain prescribed standards.(d) The number of individuals or staff required to insure adequate supervision and care of the adults served.(e)The appropriateness, safety, cleanliness, and general adequacy of the premises, including maintenance of adequate health standards to provide for the physical comfort, care, protection, and well-being of the adults served.(f) Provisions for food, clothing, educational opportunities, equipment, and individual supplies to assure the healthy physical, emotional, and mental development of adults served.(g)The type of programs and services necessary to provide appropriate care to each resident admitted.(h) Provisions to safeguard the rights of adults served, including cooperation with rights protection systems established by law.(i)Provisions to prescribe the rights of licensees.(j) Maintenance of records pertaining to admission, progress, health, and discharge of adults. (k) Filing of reports with the department.(l)Transportation safety used by adult foster care facilities.

Adult Foster Care Large Group Homes (13-20) Licensing Rules

These rules regulate adult foster care large group homes. These rules regulate homes for the aged. Fire Safety Rules for Adult Foster Care Family and Small Group Homes (6 or less)

These rules regulate fire safety for adult foster care homes licensed for 6 or less.

Child Development and Care Program
(Human Services, Family Independence Services Administration)

The proposed rule(s) will impose penalties and disqualifications on child care providers and clients receiving child care funds who are found either non-compliant with child care requirements or guilty of fraudulent activities. The rules will impose minimum and maximum penalties on providers and clients.

Licensing Rules for Child Caring Institutions
(Human Services, Office of Children and Adult Licensing)

This rule set was last promulgated in 1983 and needs to be brought up to date with changes made in the enabling statute, 1973 PA 116. The current breakdown between Parts 2 and 3 is not relevant to the way institutions are currently run and needs to be revised. 1973 PA 116 has additional conditions regarding the use of restraint and seclusion for specific types of CCIs that must be addressed in the rules. A committee will be formed to review the entire rule set, including fire safety and environmental health and will include representatives from other affected state agencies, advocacy groups, and licensed organizations.
