Placement of Adults who have a Mental Illness or a Developmental Disability into Community Based Dependent Living Settings
(Community Health, Mental Health and Substance Abuse Administration)

These rules provide for the placement of adults who have a mental illness of developmental disability into community based dependent living settings. These rules would be amended to: 1. Strengthen the person-centered planning process. 2. Address adequacy, training and continuity of direct care staff.

These rules would establish standards for providers of in-home services or supports to adults with mental illness or developmental disability.

Disciplinary Proceedings
(Community Health, Bureau of Health Professions)

New rules are being proposed to codify within the Disciplinary Proceedings Rules current guidelines for the reinstatement of a license or registration that the Department established under Section 16245(6) of the Public Health Code. In addition, the current rules will be revised to update information in those rules.

Ionizing Radiation Rules

The IRR provide for the control and regulation of sources of ionizing radiation. Sources of ionizing radiation include x-ray and other radiation producing machines and radioactive material. Due to executive orders noted below, both the DCH and the DEQ have regulatory authority over selected portions of the current IRR pertinent to their department's activities. New rules will be promulgated by each department that will eliminate this dual regulatory authority. Rescission of the entire IRR is planned, with the DCH rescinding the portion of the IRR under its purview, and concurrently the DEQ rescinding the rules under its purview.

Ionizing Radiation Rules

The Department of Environmental Quality (DEQ) and the Department of Community Health (DCH) are collaborating on revising the IRR. An Advisory Committee comprised of radioactive materials licensees and x-ray program registrants has been established to review proposed statutory and rules revisions. Public hearings will be scheduled when a draft rules package is complete. The target for formal promulgation of new rules is September 1, 2010.

New rules will be added to replace the rescinded rules.

The proposed administrative rule would establish procedures for the handling of complaints and requests for an APA hearing pursuant to the Sharing Health Care Information Act.

Board of Chiropractic - General Rules
(Community Health, Bureau of Health Professions)

The proposed rules will do all of the following: "Clarify the requirements for licensure by examination and licensure by endorsement. "Update accreditation standards for chiropractic educational programs. "Provide a definition for "distance learning" continuing education programs. "Increase the number of continuing education hours required for relicensure. "Require that chiropractic schools submit information to the Department regarding the continuing education programs being offered by the school. Also, the proposed rules require that schools submit the information at the start of the academic year and before holding the program. "Specify the information a licensee is required to include in an initial patient record entry and subsequent patient record entries.

Computed Tomography

The Ionizing Radiation Rules (R325.5001 to R325.5665) provide for the control and regulations of x-ray and other ionizing radiation machines. This new rule set will add appropriate regulations governing the use of computed tomography (CT) machines. Regulations covering personnel, equipment, quality control, facility design, and radiation surveys are planned.

Board of Physical Therapy - General Rules

Public Act 55 of 2009, which took effect on June 25, 2009, amended part 178 of article 15 (Physical Therapy) of the Public Health Code to require licensure in order to practice as a physical therapist assistant. The proposed rules will implement the requirements of Public Act 55.

Reporting of Traumatic Injuries

The rule would establish requirements for reporting of traumatic injuries. It would authorize the state Department of Community Health and local health departments to obtain identifiable health information from licensed health professionals and health agencies, including hospitals and other facilities licensed to provide health services, about patients with traumatic injuries. It would authorize the Department and local health departments to require health professionals and health facilities to report each patient who had sustained a particular type of injury when, and only when, requested.
