The Small Business Pollution Prevention Assistance Loan Fund provides low-interest loans to small businesses undertaking pollution prevention projects. The revised rules would address legislative changes that occurred subsequent to the promulgation of current rules and add clarity to the program.

Deaf Person's Interpreters Act Rules

PA 23 and PA 24 of 2007 amend PA 204 of 1982 and became effective on June 29, 2007. This legislation requires the department to draft rules to accomplish the following:· Establish rules on minimum credential requirements and levels for qualified interpreters.· Establish standards for testing.· Establish minimum standards of practice.· Establish standards of application, testing, revocation, suspension, limitation of certification and grievances.· Establish standards of continuing education requirements.· Establish the mechanism to verify compliance under the act.· Establish standards for credentialing verification.· Coordinate rule promulgation with the Department of Education (DOE) Michigan Administrative Rules of Special Education (MARSE).

Construction Code - Part 10. Michigan Uniform Energy Code

When this rule set was originally opened it was the intent the Michigan Uniform Energy Code residential energy code rules would be updated to adopt the 2009 International Residential Code, Chapter 11, Energy Efficiencies, with Michigan amendments. During the code review process the committee determined it to be in the best interest of citizens of Michigan to adopt the 2009 International Energy Conservation Code (IECC), with Michigan amendments. The Michigan Uniform Energy Code will meet or exceed the requirements of the 2009 International Energy Conservation Code, which will allow the State of Michigan to receive federal funding under the U.S. Department of Energy's (DOE) State Energy Program (SEP). Adoption of the 2009 IECC will preclude the Michigan Uniform Energy Code rules from being formatted for incorporation into the printed version of the Michigan Residential Code as originally intended.

Construction Code - Part 10a. Michigan Uniform Energy Code

When this rule set was originally opened it was intended the Michigan Uniform Energy Code Part 10a, commercial energy efficiency requirements, would be updated to adopt the 2009 International Energy Conservation Code. During the code review process, the committee recently determined it to be in the best interest of citizens of Michigan to adopt the ANSI/ASHRAE Standard 90.1 - 2007. Chapter 13, in the final printed version of the Michigan Building Code will direct the user to the ANSI/ASHRAE Standard 90.1 - 2007. The Michigan Uniform Energy Code will meet or exceed the requirements of the 2009 International Energy Conservation Code, which will allow the State of Michigan to receive federal funding under the U.S. Department of Energy's (DOE) State Energy Program (SEP).

Rules are in development. Administrative Rules will be needed to implement the new Article 29 within the Occupational Code pursuant to 2006 PA 489, effective October 1, 2007, which requires the registration of individuals or entities using the title "registered auctioneer."

Beer

The proposed amendments to R 436.1629 would strike the references in both subsection (1) and (2) to barrel sizes (barrel, ½ barrel and ¼ barrel) and make reference instead to all refillable containers of beer with a capacity of over five gallons. The mandatory $30 deposit on beer containers would be changed to a minimum $30 deposit, thus allowing suppliers of these containers to charge a higher deposit if they so choose.

Disciplinary Proceedings

New rules are being proposed to codify within the Disciplinary Proceedings Rules current guidelines for the reinstatement of a license or registration that the Department established under Section 16245(6) of the Public Health Code. In addition, the current rules will be revised to update information in those rules.
