The proposed rules would establish procedures under which the department could divest itself of approximately 700 miles of state owned railroad property. The rail lines are currently operated by private companies under contract with the department.

The proposed rules would eliminate duplicative state regulations by rescinding R 259.352 to R 259.353 and amending R 259.351 to require adherence with federal regulations. Under proposed R 259.351, (1) any operator engaging in the carriage of persons or property in common carriage operations solely between points entirely within the State of Michigan shall comply with all applicable federal regulations, and (2) prior to any operations, owner(s) shall furnish the Michigan Aeronautics Commission with satisfactory proof of a surety bond in the amount of $50,000 to cover any advance ticket sales.

The proposed rules govern MDOT's prequalification process which determines the contractors ability to perform certain kinds of transportation related construction work and the overall capacity of the contractor for simultaneous performance of transportation related construction work. In addition, it governs the process for appealing those determinations.

The proposed rules for hearings and appeals should be rewritten to follow the Administrative Procedures Act. The current process of hearing appeals concerning driveways is inefficient and does not follow the Act. A rule also needs to be added to address an appeal to a hearing officer's finding by making the decision of the hearing officer the final decision of the agency that is appealable only to state court.

The proposed rules would clearly establish where seaplanes can operate upon the navigable waters of the state available for use under the public trust doctrin. The proposed rules would establish procedures for establishing local ordianances which might restrict or prohibit seaplane operations.

R 259.241 - 247 describe the physical standards that public airports, seaplane bases, heliports and helistops must maintain in order to be licensed by the Commission. R 259.251 - 254 describe the license application and approval process for public use airports, seaplance bases, heliports and helistops. R 259.311 - 312 descibe the appointment, licesing, responsibilities and duties of managers and assistant managers at public use airports, seaplane bases, heliports and helistops.

The proposed changes would alter the form, but not the content, of R 259.401 (1) (a) and R 259.401 (2) to reflect changes that were inadvertently left out of the rule as certified by LSB and ORR and as submitted to the Office of the Great Seal. The changes that will be made were requested at the public hearing on this rule held on March 31, 2000.

PA 384 of 2004, effective October 12, 2004, requires the department to draft rules to govern the administration of the newly enacted local bridge program. The Act further provides that "the rules shall set forth the eligibility criteria for financial assistance under the program and other matters related to the program that the department considers necessary and desirable."
