Casino Interest Registration

The Casino Interest Registration Act requires a person who holds a "casino interest" to file a registration from with the Secretary of State. A notice of termination must be filed within 30 days after the person ceases to hold a casino interest. The Department of State is required to disseminate summaries of persons holding casino interests, and to take certain actions if it appears the Act may have been violated. The proposed rules would govern these activities.

Section 55(6) of the Michigan Campaign Finance Act prohibits coporations, joint stock companies, domestic dependent sovereigns and labor organizations from soliciting or obtaining contributions to their separate segregated funds unless "the individual who is contributing to the fund affirmatively consents to the contribution at least once in every calendar year."

Breath Alcohol Ignition Interlock Device

The proposed rules will prescribe the following: the approval of laboratories to certify devices, the approval of devices, and the withdraw of a laboratory and device approvals; to be followed when circumvention reports are received by the department; and to be followed if a manufacturer fails to comply with section 625k. These rules will also prescribe the responsibilities of device manufacturers to monitor the use of the devices and to report circumvention attempts to the department.

The Department of State is promulgating rules to proscribe the procedures to be followed by the Driver License Appeal Division when ordering the installation of, and responding to violations regarding, devices. The proposed rules will also update the current Driver License Appeal Division General Rules, which were promulgated in 1992, and which have not been subsequently amended.

Uniform Commercial Code Filing Office Rules

2000 PA 348 adopted Revised Article 9 (RA9) of the Uniform Commercial Code. RA9 makes substantial changes to the requirements for filing a financing statement in order to perfect a security interest in collateral. It dramatically expands the role of the Department of State as the central filing office for most financing statements.
