The rules define terms; prescribe methods for operation of two major programs provided in Act 302 of 1982, as amended, (law enforcement distribution and competitive grant program); specify restrictions on funding and program eligibility; and specify operational requirements for the Commission.

Automated Fingerprint Identification System

The proposed rules rescind 5 Automated Fingerprint Identification System (AFIS) rules. These rules define the requirements which AFIS operators must meet in order to be approved by the AFIS Policy Council. Because of the changing technologies, these qualifications are changing. It would be more efficient to utilize a board of peers to determine if the applicant is qualified. The board would then make recommendations to the AFIS Policy Council for approval.

Drunk Driving Prevention Equipment and Training Fund

The following rule limits the use of Drunk Driving Prevention Equipment and Training Fund to the administration of the fund, to the purchase and maintenance of evidential breath alcohol testing equipment, and to provide training in the use of that equipment. These proposed rules will allow purchase of other types of breath alcohol testing equipment and allow the department to expend the fund as grants to local law enforcement agencies for this equipment.

R28.951 of the Michigan Administrative Code will be amended to delete the present language and incorporate by reference 49 CFR Ch. V, Section 571.218 Standard No. 218; of the Certified Federal Standard for motorcycle protective headgear.

Uniform Traffic Code for Cities, Townships, and Villages

The intent is to modify the Uniform Traffic Code, eliminating parts that substantially duplicate sections of the Michigan Vehicle Code (MVC). Acts 257-260 or 1999 provide municipalities the authority to adopt the MVC and other laws by reference, eliminating the need for a substantial portion of the UTC. Many of the remaining sections will be amended to clarify language or otherwise update them to current standards or practices.

Tests for Breath Alcohol

The intent is to modify the rules on Tests for Breath Alcohol to bring testing standards into compliance with current body alcohol content standards due to the enactment of 1994 PA 449 and 2003 PA 61. The amended rule would also delete references to repealed statutes, changing the cities to the statutes that replaced the repealed sections of law. Other language and formatting changes may be required by LSB to bring the rule set into compliance with current standards for administrative rules.

Rule set R 28.4102 et seq., R 28.4151 et seq., and R 28.4351 et seq. will be revised and consolidation into one rule set with seven parts. Rule set R 28.4301 et seq. will be collapsed into part three and R 28.4301 et seq. will be rescinded. The revised rule set will be renumbered. This will eliminate duplication, provide continuity of regulation with respect to law enforcement standards and training, and accommodate revisions of the statute and Executive Order.
