The board intends to revise its licensure by endorsement rule to reflect a greater mobility for podiatrists who hold licensure in other states.

To accommodate individuals who currently are pursuing a master's degree that is not in psychology but that otherwise complies with the rule's coursework requirements, the revised rule would specify a date when the new requirement would take effect. The proposed rule also would correct outdated references to the Department of Licensing and Regulation; rescinded rules concerning certification of psychologist under provisions of the Public Health Code that have expired; and, update information and accreditation standards.

Under the current rules, a separate license is required for each principal place of business or professional practice. A principal place of business or a professional practice is the physical location where controlled substances are manufactured, grown, cultivated, processed, or by other means produced or prepared, distributed, prescribed, stored, or dispensed by a licensee. The rules would be revised to specify that a separate license would not be required at a location where a controlled substance is prescribed but not manufactured, grown, cultivated, processed, or distributed, as long as a prescriber held a controlled substances license for a principal place or business or professional practice.

The rules would establish requirements for licensure as an audiologist pursuant to Public Act 97 of 2004. An applicant for licensure will have to possess either a master's degree or a doctoral degree in audiology from a regionally accredited college or university approved by the Board of Audiology and will have to have completed at least nine months of supervised clinical experience in audiology. The act also requires the Department, in consultation with the Board, to provide that licensure applicants pass an examination dealing with all aspects of the practice of audiology before a license is issued. The Act permits the Department, in consultation with the Board, to develop its own examination and to promulgate rules to establish standards for that examination or to adopt by reference all or parts of an examination developed by an outside entity that it determines offers an appropriate examination. The Department also may promulgate rules to adopt by reference any supplement or update to the examination. In addition, the Act requires the Department to promulgate rules to require licensees seeking renewal to furnish evidence acceptable to the Department and Board of the successful completion of at least 10 clock hours of continuing education courses or programs related to the practice of audiology and designed to further educate licensees.

Pursuant to the Public Health Code (PHC), the department is authorized to promulgate rules to establish requirements for reporting and other surveillance methods for measuring the occurrence of disease, infections, and disabilities and the potential for epidemics (MCL 333.5111). The problem is the rules promulgation process is slow and cumbersome. This process doesn't meet the need to rapidly designate reportable diseases. As a result, the rules do not include smallpox, SARS, monkeypox, and other pathogens that should be reportable. Conclusion: The department needs an immediate process in order to track emerging infectious diseases and bioweapons. There was a finding of emergency found regarding this rule, and the rule was promulgated under the Emergency Rule Promulgation Process. The Emergency Rule will expire June 1, 2005.

Current best practice standards would provide for counseling services as needed to be contained in the individualized treatment plan. The proposed amendments "tie" the required progress reports to the treatment plan and require these so long as the treatment plan identifies a need for and includes required counseling services.

Pneumococcal conjugate vaccine was licensed in February of 2000 for use in children less than 5 years of age. In October of 2000, the Advisory Committee on Immunization Practices (ACIP) made recommendations that this vaccine become part of the routine vaccination schedule for children. In the short history of using this vaccine, it has already proven to be extremely safe and effective at preventing invasive pneumococcal disease. This proposal requires pneumococcal conjugate vaccine for entry into a program of group residence, care, or camping.

In addition, the proposed rules will do the following: permit a pharmacy to function in one or more capacities in prescription processing when appropriate records are maintained, specify that a dispensing pharmacist and pharmacy are responsible for patient counseling, and specify information to be included on a prescription label. The rules also will require a dispensing pharmacy to report to the department information required in R 338.3162b for each controlled substance prescription. In addition, the rules will require these pharmacies to maintain records and will specify the information that will have to be recorded.

The range of numbers being rescinded in this Request for Rulemaking (RFR), [R 338.951 - R 338.963 and R 338.980 - R 338.990], will be rescinded by the Department of Community Health. The remaining rules within the rule set, R 338.964 - R 338.979, will be rescinded by the State Office of Administrative Hearings and Rules in a separate RFR.

It authorized the state Department of Community Health to obtain identifiable health information from health care providers and health agencies about non-medicinal, unintentional chemical poisoning occurrences. There are two reasons for this amended rule. (1) There were errors to the final, published rule set. (2) Although "health agency" as defined in the rule covers clinical laboratories, additional clarification regarding reporting requirements for laboratories is needed.

Statewide Trauma System

At the scene of any crash or other event involving traumatic injury, EMS providers must identify those patients who are at greatest risk for severe injury and must determine the most appropriate facility to which to transport persons with different injury types and severities. This decision process is known as, "field triage". The current adopted set of Statewide Trauma System rules reflect two different sets of "field triage" criteria located in two different sections of the rules causing a conflict for implementation. The correct "field triage" criteria to be utilized is published by the American College of Surgeons with support by the CDC and endorsed by other national organizations. The incorrect "field triage" criteria is referenced and specifically listed in an adult and pediatric table. We propose that the Adult and Pediatric field triage criteria tables be removed from the rules, so that the proper "field triage" criteria may be the only and proper reference for "field triage" criteria based on national standards of the injured patient.
