2009-002 CH

Board of Psychology - General Rules
(Community Health Bureau of Health Professions)

The current rule requires doctoral programs in psychology to have National Register (NR) designation or American Psychological Association (APA) accreditation by June 30, 2009. The proposed rule change will extend that deadline to August 1, 2011.

2009-003 CH

Reporting Of Non-Suicidal, Non-Medicinal Chemical Poisonings
(Community Health Public Health Administration)

This is an amendment to the rule that was effective 9/16/2007. The rule established requirements for reporting of known or suspected injury or illness associated with unintentional exposure to chemicals, excluding drugs and medicinal substances. It authorized the state Department of Community Health to obtain identifiable health information from health care providers and health agencies about non-medicinal, unintentional chemical poisoning occurrences. There are two reasons for this amended rule. (1) There were errors to the final, published rule set. (2) Although "health agency" as defined in the rule covers clinical laboratories, additional clarification regarding reporting requirements for laboratories is needed.

These rules provide for the safe use of abrasive wheels in, around and about places of employment including specifications for safety guards, flanges, chucks and rules for storage, handling, mounting and use of grinding wheels.

Statewide Trauma System
(Community Health Health Policy, Regulation and Professions Administration)

At the scene of any crash or other event involving traumatic injury, EMS providers must identify those patients who are at greatest risk for severe injury and must determine the most appropriate facility to which to transport persons with different injury types and severities. This decision process is known as, "field triage". The current adopted set of Statewide Trauma System rules reflect two different sets of "field triage" criteria located in two different sections of the rules causing a conflict for implementation. The correct "field triage" criteria to be utilized is published by the American College of Surgeons with support by the CDC and endorsed by other national organizations. The incorrect "field triage" criteria is referenced and specifically listed in an adult and pediatric table. We propose that the Adult and Pediatric field triage criteria tables be removed from the rules, so that the proper "field triage" criteria may be the only and proper reference for "field triage" criteria based on national standards of the injured patient.

Withdrawn 9/8/09 The rule set will be amended to allow certain workers at charitable gaming events to be employees of the location or supplier, define / clarify management responsibilities, allow suppliers to advertise charitable gaming events, and rescind Numeral Game and Manufacturer sections which are obsolete.

Part 381 Ionizing Radiation

This standard protects Michigan employees from overexposure to ionizing radiation in the workplace by monitoring their exposures, requiring caution signs and labels to warn employees of the presence of radiation; and requiring an immediate evacuation warning signal.

2009-024 LG

On-Premises Licenses
(Energy, Labor & Economic Growth Liquor Control Commission)

R 436.1409; MAC; which is requested for rescission, prohibits an on-premises licensee of the Commission from allowing a person to expose to public view, on the licensed premises, certain parts of the body, namely the pubic region, anus or genitals or to display other types of nudity prohibited by state or local ordinance. This rule also prohibits films, television, slides or other electronic reproductions of this type of nudity on the licensed premises. R 436.1411; MAC; also requested for rescission, prohibits the performance or simulated performance of certain sexual acts, namely intercourse, masturbation, sodomy, bestiality, fellatio or cunnilingus on a premises licensed by the Commission for the on-premises consumption of alcoholic liquor. This rule also prohibits the showing of films, television, slides or other electronic reproduction of these specified acts or simulation of these acts on the licensed premises.

Rate Case Filing Requirements for Electric and Gas Utility Companies

Withdrawn 11/10/2009 The Commission's current rules for rate case filing requirements were established by orders issued in 1992 and 1976 (gas utilities - January 17, 1992 order in Case No. U-10039; electric utilities - May 10, 1976 order in Case No. U-4771) On October 6, 2008, Public Act 286 became effective. Section 6a(6) of Act 286 provides: "[T]he commission shall adopt standard rate application filing forms and instructions for use in all general rate cases filed by utilities whose rates are regulated by the commission. . . . The commission may, in its discretion, modify the standard rate application forms and instructions adopted under this subsection." On October 21, 2008, in Case No. U-15895, the Commission issued an order seeking comments from all interested parties on standard rate application filing forms and instructions. On December 23, 2008, the Commission issued a second order directing the Commission Staff to write rules in accordance with the findings in that order.
