    ELECTRICAL SUPPLY AND COMMUNICATION LINES AND ASSOCIATED EQUIPMENT


(By authority conferred on the public service commission by  section   7   of 
Act No. 106 of the Public Acts of 1909, as amended, sections 2   and   3   of 
Act No. 206 of the Public Acts of 1913, as amended, sections 4   and   6   of 
Act No. 3 of the Public Acts of 1939, as amended, and  section   5   of   Act 
No. 419 of the Public Acts of 1939, as amended,  being  SS460.557,   460.102, 
460.103, 460.4, 460.6, and 460.55 of the Michigan Compiled Laws)


R  460.811   Definitions.
  Rule 1. As used in these rules:
  (a) "Commission" means the Michigan public service commission.
  (b) "Utility" means an electric or  telecommunications   company,   whether 
private, corporate, or cooperative, that operates under  the  jurisdiction of 
the commission.

R  460.812   Purpose.
  Rule 2. These rules are intended to promote safe and  adequate  service  to 
the public and to provide standards for uniform  and   reasonable   practices 
for a utility. These rules do not relieve a utility from any  of  its   other 
duties under the laws of this state.

R  460.813   Standards of good practice; adoption by reference.
  Rule 3. Parts 1, 2, and 3 and sections 1, 2, 3, and 9   of   the   national 
electrical safety  code,  1997  edition  (ANSI-C2-1997),   are   adopted   by 
reference in these rules as standards of accepted good practice. Parts  1, 2, 
and 3 and sections 1, 2, 3, and 9 of  the  national  electrical  safety code, 
1997 edition (ANSI-C2-1997), are available from the Michigan  Public  Service 
Commission, P.O. Box 30221, Lansing, MI 48909, at a cost as of  the  time  of 
adoption of this rule of 5 cents per page, plus $15.12  per   hour  of  labor 
plus  postage,  or  from  The  Institute  of  Electrical   and    Electronics 
Engineers,  Service Center, P.O. Box 1331, Piscataway, NJ  08855-1331,  at  a 
cost as of the time of adoption of this rule of $63.00.

R  460.814   Exemption  from  rules;  application   to   commission;   public 
hearing.
  Rule 4. An exemption from these rules may be granted by the  commission.
A party seeking an exemption shall file an application  with  the  commission 
specifying  the  location  to  be  exempted.  After  the   filing    of    an 
application, the commission shall investigate the  circumstances  and   shall 
determine if  granting  an  exemption  is  in  the   public   interest.   The 
commission may conduct a public hearing in order to  determine  whether   the 
public interest would be adversely affected by granting an application for an 
exemption to these rules. The commission may exempt a specific location  from 
these rules for any of the following reasons:
  (a) The cost of complying  with  the  rules  is  not   justified   by   the 
protection secured.
  (b) Equivalent or safer construction is more readily  provided  in  another 
manner.
  (c) The rules are impractical for any other reason.

R  460.815   Rescission.

  Rule 5. R 460.521 to R 460.572  of  the   Michigan   Administrative   Code, 
noted  on  page  4706  of  the  1979  Michigan   Administrative   Code,   are 
rescinded.
